1. Parties and scope
These Terms of Use ("Terms") govern your use of FotonAI, provided by InsightTech Bilişim Sanayi ve Ticaret Anonim Şirketi ("FotonAI", "we"). Your mandatory consumer rights remain unaffected.
2. Service description
FotonAI provides photo editing, style transformations, text-to-image generation and other AI features that may evolve. Generations require connectivity and sometimes credits and third-party AI services. Outputs may vary, and uninterrupted service or any particular aesthetic result is not guaranteed.
3. Your uploads and permissions
You or the relevant rights holders retain rights in photos, prompts and materials you provide. You represent that you have the permissions required to submit them, including for images of other people, minors, private scenes, brands and copyrighted materials. You grant us only a limited, non-exclusive, worldwide technical license to process submitted materials to fulfill your requests and necessary safety/compliance functions. You do not transfer ownership of your uploaded content to us.
4. Ownership and use of outputs
To the extent that we own any assignable rights in outputs, we assign those rights to you or grant you a perpetual, non-exclusive license, as permitted by law and applicable provider terms. You may use your generated images for personal and lawful commercial purposes, subject to third-party rights and applicable law. We cannot promise that copyright arises in every jurisdiction, that outputs are unique, or that an output does not infringe someone else’s rights. Third-party trademarks, likeness rights and copyrights remain with their owners. You are responsible for assessing rights before publishing or selling an output.
5. Prohibited conduct
Do not use FotonAI for child sexual abuse material, non-consensual intimate imagery, harassment, threats, unlawful discrimination, fraud, deceptive impersonation, infringement, automated attacks, circumvention of safeguards or other unlawful activity. We may restrict operations or account access when reasonably necessary and legally permitted.
6. Credits and generation
Credit costs for eligible functions are displayed in the app. The backend accounts for credits used in successful operations. Entitlements, renewals, expiration and refund terms depend on the particular product as disclosed at purchase; we do not make blanket promises beyond those disclosures. Report technical failures or duplicate charges to support for review under applicable consumer rules.
7. Anonymous accounts, changing devices, and access to credits
FotonAI may use an automatically created anonymous account for authentication. Credits and entitlements are linked to the relevant FotonAI user identifier (UID), not merely to a phone, device or Apple Account. If the app is deleted, the device is reset or the app is used on another device, access to the same anonymous account may not be recoverable. As a result, credit balances and in-app history associated with the previous UID may not automatically appear or transfer to the new session.
Users should consider this limitation before uninstalling or changing devices. Purchased consumable credits do not expire merely because time passes, although losing access to the anonymous account may prevent their use. Subscriptions and restorable purchases are handled under Apple's applicable restoration rules and verifiable purchase records. Using Restore Purchases does not guarantee that unused credits tied to an old anonymous UID will be transferred to a new UID. If you lose access to a paid balance, contact support; we will review the issue in light of verifiable purchase records and applicable consumer rights. Nothing in this clause limits mandatory refund, performance or other statutory rights.
8. Subscriptions, cancellation and refunds
FotonAI may offer weekly or annual auto-renewing subscriptions and eligible credit packs through Apple’s App Store. Price, period, entitlements, renewal and trial terms (if any) are displayed before purchase. Manage or cancel subscriptions in Apple account settings; uninstalling the app or deleting your FotonAI account does not cancel Apple billing. Refunds follow applicable Apple processes and mandatory consumer law. RevenueCat may be used to validate entitlements.
9. Third parties and service updates
Photo processing relies on external AI providers and our infrastructure relies on Firebase/Google Cloud. Applicable third-party terms may also apply. We may update styles, models and features for security, compliance, performance or availability, respecting required notice and consumer rights.
10. Reporting and accuracy
AI outputs may contain errors, unexpected changes or similarities to third-party material. Report problematic outputs through the in-app content-report mechanism. Authorized staff may review related metadata and a limited preview. Reporting does not automatically establish an ownership decision or refund entitlement.
11. Account deletion and termination
You may delete your account in Settings. Deletion may be irreversible and may remove account-associated data and credits, subject to legally necessary and de-identified records. You must cancel Apple subscriptions separately. Material violations may result in proportionate service restrictions where permitted by law.
12. Disclaimers and mandatory rights
We aim to deliver the service with reasonable care. Network interruptions, provider outages and unexpected AI results may occur. Nothing in these Terms excludes mandatory consumer, data protection, gross-negligence, intentional misconduct or other non-waivable rights or liabilities.
13. Apple terms
FotonAI is supplied by its developer, not Apple. The developer is responsible for maintenance, support and legally required compliance. To the extent permitted, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce relevant provisions. You must also comply with applicable storefront and third-party service terms. Any mandatory Apple minimum EULA terms apply to the extent required.
14. Privacy and applicable law
Processing of personal information is described in our Privacy Policy and, where applicable, separate Turkish privacy notice. Mandatory consumer protections and available remedies of your place of residence remain unaffected.
